Court Grants Rehearing in Autism Case

This week the California Court of Appeal granted Consumer Watchdog’s petition for rehearing in its s
eminal lawsuit against the Department of Managed Health Care over treatment for autistic children.

Consumer Watchdog scored a major victory in the recent decision, which bars state regulators and HMOs from discriminating against children in the future on the basis of whether treatment providers hold state licenses.

However, Consumer Watchdog had urged the Court to reconsider part of the ruling that could be read to put behavior analysts at risk of being prosecuted for the “unlicensed practice of psychology” for care provided prior to the passage of a recent state autism law.
